These terms govern your use of the Beyond Better Studio website and the "free draft" offer. By using this site or submitting the form, you agree to them.

1. Acceptance of these terms

By accessing this website or requesting a free draft, you confirm you are at least 18 years old (or have authority to act for a business) and that you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the site.

2. The free draft offer

We may create a working draft of a website based on the details you provide, at no cost and with no obligation on either side. Please note:

• A draft is a preview, provided "as is," to help you decide whether to work with us. It is not a finished product or a binding commitment to deliver a project.
• Until a project is agreed in writing and any agreed fees are paid, the draft and all design files remain the property of Beyond Better Studio. You may not publish, sell, or reuse a draft without our permission.
• We may decline to create a draft, or stop work on one, for any reason.

3. Services, quotes & payment

Every project is quoted individually. Any price we share is an estimate until confirmed in a written agreement (which may be an email). The scope, fees, timeline, and payment terms for paid work will be set out in that agreement, which together with these terms forms the contract between us. Hosting, domain, and ongoing care may be offered as a recurring service and billed separately.

4. Intellectual property

All content on this website — text, designs, graphics, code, and the Beyond Better Studio name and logo — belongs to us and is protected by law. On full payment for a completed project, ownership of the final deliverables we create for you transfers to you as set out in your project agreement, except for any third-party components, fonts, stock assets, or our underlying tools and reusable code, which remain under their respective licenses or our ownership. Content you provide to us (your text, logo, photos) remains yours.

5. Your responsibilities

• Give us accurate information about your business.
• Make sure you own or have the right to use any materials you send us (logos, photos, text), and that they don't infringe anyone's rights or break the law.
• Use the site lawfully — don't attempt to disrupt it, misuse the form, or submit harmful or unlawful content.

You agree to indemnify us against claims arising from materials you provide or from your misuse of the site.

6. Third-party services

Your website may rely on third-party services (for example hosting, domain registration, fonts, or maps). Those services have their own terms, and we're not responsible for their availability or actions. We'll always aim to choose reputable providers.

7. No guarantee of specific results

We build websites designed to perform well, but we can't guarantee specific outcomes such as search rankings, traffic, leads, or revenue, as these depend on many factors outside our control.

8. Disclaimer

This website and the free draft are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Beyond Better Studio will not be liable for any indirect, incidental, or consequential damages arising from your use of this site or the free draft offer. Where liability cannot be excluded, our total liability is limited to the amount you have paid us (if any) for the services in question.

We may suspend or withdraw access to this site, or decline to provide a draft or services, at any time. Sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply after any termination.

11. Governing law

These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in New York, and you agree to that jurisdiction.

12. Changes to these terms

We may update these terms from time to time. The "last updated" date above shows the current version. Continuing to use the site after a change means you accept the updated terms.
